Article 3. Applicability
- These Terms of Service apply to every offer made by Altaris and to every Contract concluded between Altaris and a Customer.
- Before a Distance Contract is concluded, the text of these Terms of Service is made available to the Customer on the Website, in a way that allows the Customer to store it on a durable data carrier.
- Article 11 applies only to Business Customers. All other articles apply to all Customers, unless an article states that it applies only to Consumers.
- Any general terms and conditions of a Business Customer are expressly rejected.
- If one or more provisions of these Terms of Service are void or annulled, the remaining provisions remain in full force. The void or annulled provision will be replaced by a provision that comes as close as possible to its original intent.
- Where these Terms of Service conflict with specific conditions that apply to a particular offer or promotion, the Consumer may always rely on the provision most favourable to them.
Article 4. The offer
- Every offer is without obligation, unless stated otherwise. Offers are valid while stocks last.
- The offer contains a complete and accurate description of the Products, sufficient to allow the Customer to make a proper assessment. Images are a faithful representation of the Products; minor differences in colour or packaging do not entitle the Customer to compensation or termination.
- Each offer states clearly the price including VAT, any delivery costs, the method of payment and the method of delivery.
- Obvious mistakes or errors in the offer, such as pricing errors, do not bind Altaris.
Article 5. The Contract
- The Contract is concluded when the Customer completes and submits the order on the Website and Altaris confirms receipt of the order by email.
- Altaris takes appropriate technical and organisational measures to secure the electronic transfer of data and the payment environment.
- Altaris may refuse an order, or attach special conditions to its execution, if there are reasonable grounds to do so. This includes suspected fraud, misuse of discount codes or orders placed for resale without a separate wholesale agreement. Altaris will inform the Customer of a refusal within 3 Days of receiving the order and will refund any amount already paid.
Article 6. Right of withdrawal (Consumers only)
- A Consumer may withdraw from a Distance Contract for Products other than Food and Drink Products within 14 Days, without giving any reason. The Withdrawal Period starts on the Day after the Consumer, or a third party designated by the Consumer, receives the Product.
- The right of withdrawal does not apply to Food and Drink Products, whether opened or unopened. Coffee is a perishable product with a limited shelf life and, once it has left our care, cannot be returned to sale for reasons of food safety and hygiene.
- During the Withdrawal Period, the Consumer will handle the Product and its packaging with care. The Product must be returned unused, complete and in its original packaging. The Consumer is liable for any reduction in value resulting from handling the Product beyond what is necessary to establish its nature, characteristics and functioning.
- To exercise the right of withdrawal, the Consumer notifies Altaris within the Withdrawal Period by email to info@altaris.coffee, with an unambiguous statement of their decision to withdraw. The procedure is set out in our Return Policy.
- The Consumer returns the Product within 14 Days of notifying Altaris. The direct cost of returning the Product is borne by the Consumer.
- Altaris refunds all payments received from the Consumer, including the cost of standard delivery, within 14 Days of receiving the notice of withdrawal. Altaris may withhold the refund until it has received the Product back, or until the Consumer has shown proof of return, whichever is earlier. The refund is made using the same payment method the Consumer used.
- The exclusion in paragraph 2 does not affect the Consumer's rights under Article 10 where a Product is damaged, defective, incorrect or incomplete on delivery.
Article 7. Prices and discount codes
- All prices on the Website are in euros and include VAT. Delivery costs are shown separately before the order is placed.
- Prices stated in an offer do not increase during the validity of that offer, except as a result of changes in VAT rates.
- Promotions and discounts are valid for the period stated, while stocks last.
- Discount codes are personal, may be used once per Customer unless stated otherwise, cannot be exchanged for cash and cannot be combined with other discounts.
- Discount codes may not be published, sold or shared on discount, coupon or deal websites, or used for commercial purposes.
- In the event of fraud or misuse, Altaris may cancel the discount code, refuse or cancel the order, and recover any discount already granted.
Article 8. Payment
- Consumers pay in full at the time of ordering, using one of the payment methods offered at checkout on the Website.
- Payments are processed through Shopify Payments. Altaris does not store payment card details.
- Altaris will not ship an order until payment has been received.
- Invoices are sent electronically to the email address provided by the Customer.
- Payment terms for Business Customers are set out in Article 11.
Article 9. Delivery
- Altaris delivers to addresses within the member states of the European Union. Delivery costs and the estimated delivery time for each destination are shown at checkout.
- Deliveries are made by a third-party carrier to the address the Customer provides. The Customer is responsible for providing a correct and complete delivery address.
- Altaris will process and dispatch accepted orders as quickly as possible, and in any event within 30 Days, unless a longer delivery period has been agreed.
- If delivery is delayed, or if an order cannot be fulfilled in whole or in part, Altaris will inform the Customer no later than 30 Days after the order was placed. In that case the Customer may terminate the Contract free of charge and is entitled to a refund of any amount paid within 14 Days.
- If a Product is unavailable, Altaris may offer a Product of equivalent nature and quality. A replacement is only sent with the Customer's consent.
- For Consumers, the risk of damage to and loss of Products remains with Altaris until the moment of delivery to the Consumer or to a third party designated by the Consumer, other than the carrier.
- If a parcel is returned to Altaris because the address was incorrect or incomplete, or because it was not collected, Altaris may charge the cost of redelivery to the Customer.
Article 10. Conformity and complaints about Products
- Altaris guarantees that the Products conform to the Contract, to the specifications stated in the offer, and to reasonable requirements of soundness and usability.
- Coffee should be stored in a cool, dry place, away from direct light, in its resealed original packaging. Altaris is not responsible for any loss of quality caused by improper storage or by use after the best-before date.
- The Customer should inspect the Products on delivery. If a Product is damaged, defective, incorrect or incomplete, the Customer should notify Altaris at info@altaris.coffee within a reasonable time after discovering the defect, preferably with photographs. For Consumers, notification within two months of discovery is always considered timely.
- Where a Product does not conform to the Contract, Altaris will, at its choice and at no cost to the Customer, replace the Product, deliver what is missing or refund the purchase price.
- This article does not limit the statutory rights of Consumers.
Article 11. Business Customers
- Wholesale orders are placed through the wholesale page on the Website or by email. Quantities, prices and delivery schedules for wholesale orders are confirmed by Altaris in writing.
- Business Customers have no right of withdrawal.
- Unless agreed otherwise in writing, invoices are payable within 14 Days of the invoice date. If payment is late, the Business Customer is in default without notice and owes statutory commercial interest (article 6:119a of the Dutch Civil Code) and the extrajudicial collection costs permitted by law.
- Altaris retains ownership of all delivered Products until the Business Customer has paid all amounts due under the Contract in full.
- The risk of damage to and loss of Products passes to the Business Customer when the Products are handed over to the carrier.
- The Business Customer must inspect the Products on delivery and report visible defects or shortages within 7 Days of delivery, and hidden defects within 7 Days of discovery. After these periods, the Products are deemed accepted.
- Altaris's liability towards a Business Customer is limited to the invoice value of the Products concerned. Altaris is not liable for indirect damage, including lost profit, lost revenue or business interruption, except in the case of intent or gross negligence on the part of Altaris.
Article 12. Liability, force majeure and termination
- Altaris is not liable for damage resulting from improper storage, preparation or use of the Products, or from use after the best-before date.
- Altaris is not liable for failure to perform its obligations where this is caused by circumstances beyond its control, including disruptions at carriers or suppliers, crop failure at origin, strikes, pandemics, government measures and failures of internet or payment systems. In that case Altaris may suspend its obligations or terminate the Contract, and will refund any amount paid for Products not delivered.
- If the Customer fails to meet its obligations under the Contract, Altaris may suspend delivery or terminate the Contract, without prejudice to its right to claim compensation for damage and costs under Dutch law.
- Nothing in these Terms of Service excludes or limits liability that cannot be excluded or limited by law, including liability for intent or gross negligence, or the mandatory statutory rights of Consumers.
Article 13. Complaints procedure
- Complaints about the performance of a Contract must be submitted to info@altaris.coffee within a reasonable time after the Customer has discovered the issue, and must be fully and clearly described.
- Altaris will respond to a complaint within 14 Days of receipt. If a complaint requires a longer processing time, Altaris will send an acknowledgement within 14 Days, stating when the Customer can expect a more detailed answer.
- If a complaint cannot be resolved by mutual agreement, the dispute may be submitted to the competent court in accordance with Article 15.
Article 14. Personal data
Altaris processes personal data in accordance with the General Data Protection Regulation. How we process personal data is described in our Privacy Statement, available on the Website.
Article 15. Governing law and disputes
- These Terms of Service and all Contracts are governed exclusively by Dutch law. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.
- A Consumer who is habitually resident in another member state of the European Union retains the protection of the mandatory provisions of the law of that member state.
- Disputes with Business Customers are submitted exclusively to the competent court in Amsterdam. Consumers may submit a dispute to the competent court in Amsterdam or to the competent court of their place of residence.
Article 16. Amendments
- Altaris may amend these Terms of Service. Amendments take effect once published on the Website.
- The version of these Terms of Service in force at the time the order was placed applies to that order. Where an amendment is made during the validity of an offer, the Consumer may rely on the provision most favourable to them.
